SiteX Acceptable Use Policy
Rules for lawful and responsible use of SiteX.
SECTION A — INTRODUCTION AND SCOPE
Sitex LLC, a South Carolina limited liability company doing business as SiteX (“Company,” “we,” “us,” “our”), provides the SiteX mobile application, website, software, APIs, data layers, cost models, and related services (the “Service”).
Access to Licensed Content, including Hexagon Content and any other Provider Data subject to third-party streaming restrictions, is limited to the native SiteX mobile application. The Company’s website and any browser-based experience are used only for legal notices, help content, marketing, and related informational functions, and may not display, host, cache, export, or expose Licensed Content or Hexagon imagery except as expressly authorized in a written agreement signed by the Company and, where required, the applicable provider.
Sitex LLC owns the SiteX trademarks and service marks. Sitex Technologies LLC, a South Carolina limited liability company, owns the SiteX patents and pending patent applications, and licenses such patents to the Company. Except where the context expressly refers to Sitex Technologies LLC’s intellectual property rights or status as licensor, references in this Acceptable Use Policy to the “Company,” “we,” “us,” or “our” refer to Sitex LLC.
This Acceptable Use Policy (“AUP”) describes the rules and standards of conduct that apply to all users of the Service. This AUP supplements and should be read together with the Terms of Use, Privacy Policy, End User License Agreement (EULA), Cookie Policy, DMCA Policy, and Legal Glossary. Defined terms used but not defined here have the meanings given in those documents.
By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account and access to the Service, as described in the Terms of Use Section J.
Third-Party Licensor AUP: This AUP is in addition to, and does not replace, the Hexagon Acceptable Use Policy (available at https://hxgncontent.com/global/acceptable-use-policy), which also applies to your use of Hexagon Content within the Service. In the event of a conflict between this AUP and the Hexagon AUP, the more restrictive provision applies.
SECTION B — GENERAL CONDUCT STANDARDS
You agree to use the Service in a lawful, responsible, and respectful manner. You must comply with all applicable federal, state, and local laws and regulations; all terms and conditions of the Terms of Use, EULA, and Privacy Policy; the third-party data restrictions reproduced in the Terms of Use (Section L) and the publicly available Hexagon Acceptable Use Policy; and all in-app disclaimers and notices.
SECTION C — PROHIBITED ACTIVITIES
The following activities are strictly prohibited. This list supplements and consolidates the prohibited uses described in Terms of Use Section C.2 and EULA Section C.
C.1 Data Extraction and Scraping
Except for static PDFs and limited copying expressly generated or enabled by the Service in accordance with the Terms of Use and EULA, you may not download, export, scrape, crawl, or systematically collect any data, imagery, parcel records, map tiles, elevation data, or other content from the Service; use automated tools, bots, scripts, scrapers, spiders, or similar technologies to access the Service; create bulk copies, derivative datasets, databases, or extractable data products from any content within the Service; or mosaic, stitch, tile, or orthorectify imagery obtained through the Service.
C.2 Reverse Engineering and Competitive Use
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or underlying logic of the Service; reproduce or replicate any routing, grading, cost estimation, or terrain analysis workflows; build or develop competing products or services using information obtained from the Service; or use the Service or its outputs to train, fine-tune, validate, or generate synthetic data for any machine learning system, artificial intelligence model, neural network, or large language model.
C.3 Unauthorized Access and Security Violations
You may not attempt to bypass, circumvent, or defeat any access controls, authentication mechanisms, subscription gates, or security features; probe, scan, or test the vulnerability of the Service or any connected system; interfere with, disrupt, or degrade the performance of the Service, its servers, APIs, or infrastructure; transmit viruses, malware, ransomware, or other harmful code; access or attempt to access another user’s account, data, or credentials; or use the Service on rooted, jailbroken, or modified devices.
C.4 Account Misuse
You may not share your account credentials with any third party; create multiple accounts to circumvent usage limits, bans, or entitlement restrictions; create accounts using false, misleading, or impersonated information; resell, transfer, or sublicense your account, subscription, or any access to the Service; or use the Service in a manner that exceeds reasonable individual use patterns, including patterns suggestive of automated or non-human activity.
C.5 Unsafe and Illegal Field Use
You may not rely on approximate utility markers displayed in the Service for digging, excavation, or construction without first contacting 811 or the appropriate local utility locating service; trespass on private property based on information displayed in the Service; use the Service while driving, operating machinery, or in any manner that endangers personal safety; or rely on Service outputs in lieu of required professional surveys, engineering evaluations, environmental assessments, or regulatory approvals.
C.6 Misuse of Outputs and Professional Boundaries
You may not use the Service outputs as certified surveys, engineered plans, or regulatory submissions; present Service outputs as professional advice (surveying, engineering, environmental, zoning, legal, or financial); publicly distribute, publish, post, list, broadcast, or commercially exploit Service outputs (including but not limited to public posting on websites; real estate listing platforms or services such as Zillow, MLS, Realtor.com, Redfin, Trulia, LoopNet, or similar platforms; broker websites; syndication networks; social media accounts; or marketing collateral intended for public distribution) without prior written permission from the Company (none currently granted); or use outputs for any purpose requiring professional licensure or certification.
C.7 Licensed Content Violations
Except for the temporary caching and limited static outputs expressly permitted under the Terms of Use and EULA, you may not retain, cache, transfer, store, or grant access to Licensed Content (Hexagon or LightBox) on any device or electronic network; you may not remove, alter, or obscure any required copyright notices or attributions; and you may not violate any restriction described in Terms of Use Section L or Privacy Policy Section J.
C.8 Abusive or Harmful Behavior
You may not use the Service to harass, threaten, defame, or harm any person; submit false, fraudulent, or misleading information; or initiate fraudulent chargebacks or purchase reversals.
SECTION D — USAGE LIMITS AND FAIR USE
The Service is intended for individual use. While we do not impose rigid usage quotas on standard accounts, we reserve the right to apply reasonable fair-use safeguards to protect the performance and availability of the Service for all users. Usage patterns that substantially exceed typical individual use, occur at unusually high rates, or otherwise suggest automated or non-human behavior may trigger additional verification, temporary rate limits, or other protective measures as described in Terms of Use Section D.1A.
SECTION E — REPORTING VIOLATIONS
If you become aware of any violation of this AUP, please report it to:
Email: legal@sitexready.com
Subject line: “AUP Violation Report”
We will investigate reported violations and take appropriate action, which may include warning the user, suspending or terminating the account, removing content, or referring the matter to law enforcement.
SECTION F — ENFORCEMENT AND CONSEQUENCES
Violations of this AUP may result in one or more of the following, at our sole discretion:
- Warning or notice of violation
- Temporary suspension of account access
- Permanent termination of account and access to the Service
- Revocation of subscription access or affected entitlements where directly associated with fraud, chargeback, abuse, unlawful activity, material breach, or entitlement misuse, to the extent permitted by applicable law and platform policies
- Removal of offending content
- Referral to law enforcement or regulatory authorities
- Legal action, including claims for damages and injunctive relief
The Company reserves the right to take enforcement action without prior notice where immediate action is necessary to protect the Service, other users, licensed content, or the Company’s rights. Enforcement actions are governed by the termination provisions in Terms of Use Section J.
SECTION G — CHANGES TO THIS POLICY
We may update this AUP at any time. When we make material changes, we will update the effective date and may provide notice through the Service, by email, or by posting on our website. Material changes will be communicated through reasonable notice and, where required by law or designated by the Company, may require renewed affirmative acceptance; non-material changes may become effective upon posting. Your continued use of the Service after the effective date constitutes acceptance only where renewed affirmative acceptance is not required. If you do not agree, you must stop using the Service.
Where changes to end-user restrictions are required by the Company’s data providers (for example, updates to the Hexagon Acceptable Use Policy), they may take effect immediately, with notice provided as practicable.
SECTION H — SEVERABILITY
If any provision of this AUP is found to be unlawful, void, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from this AUP. The remaining provisions shall remain in full force and effect.
