SiteX In-App Disclaimer
Important limits on planning information, mapping, and estimates shown in SiteX.
A. GENERAL DISCLAIMER
Capitalized terms not defined herein have the meanings given in the Legal Glossary, which is incorporated by reference. References to the “Application” in this disclaimer are synonymous with and refer to the “Service” as defined in the Terms of Use and Legal Glossary; the terms are interchangeable for all legal purposes. This Application provides estimates, approximations, and modeled outputs only. Always verify conditions, measurements, and requirements with qualified, licensed professionals. This Application does not replace a land survey, engineering plan, architectural design, or regulatory approval. This Application is primarily a pre-acquisition and pre-design planning tool; no output is intended to determine whether land is suitable, buildable, or economically viable.
B. UTILITY LOCATIONS & SAFETY
Utility locations entered or displayed in the Application are APPROXIMATE and user-supplied. YOU MUST contact 811 or the appropriate local utility locating service before digging. Failure to do so may result in serious injury, death, or property damage.
C. FLOOD, SLOPE, SEPTIC & TERRAIN DATA
Flood hazard information displayed in the Application is derived in part from Federal Emergency Management Agency (FEMA) datasets, including the National Flood Hazard Layer (NFHL). FEMA does not guarantee the accuracy, completeness, or current status of this information. FEMA does not endorse this Application or any outputs generated by this Application.
This Application does not provide official flood zone determinations, insurance requirements, or compliance certifications, and is not an official Flood Insurance Rate Map (FIRM). Users should consult licensed professionals and appropriate authorities before making property, construction, or financial decisions.
Flood zone color coding, symbology, and legend conventions used in the Application follow standard practices derived from FEMA mapping guidelines for user familiarity. Use of these conventions does not imply FEMA affiliation, endorsement, or certification. This Application does not display, reproduce, or incorporate the official FEMA seal, logo, or insignia. Unauthorized use of federal agency seals and logos is prohibited under 18 U.S.C. §§ 506, 701, and 1017.
Point-of-Interaction Notice: When you select a parcel in the Application, a brief in-context flood notice is displayed for that parcel, confirming that any flood information shown is for informational purposes only and is not an official FIRM. Detailed flood zone polygons are displayed only after you enable the flood data layer. This in-context notice supplements, and does not replace, the full disclaimers in this Section C and the Terms of Use.
Slope estimates, preliminary septic-siting indicators, and terrain analyses may be outdated, incomplete, or based on generalized datasets. Field conditions may differ materially, and independent verification is required before any construction or site work.
Zoning, land-use, and development regulations are highly localized and frequently amended. The Application does not determine legal permissibility of any use. Zoning classifications displayed are derived from third-party data and may not reflect current designations, pending amendments, overlay districts, conditional use permits, variances, or other restrictions. Users must verify all zoning matters directly with the applicable local planning, zoning, or permitting authority.
D. LOCATION, GPS & DEVICE ACCURACY
Location data may be affected by device limitations, satellite availability, obstruction, or environmental conditions. Always confirm locations in the field before making decisions or performing work.
E. AERIAL, MAP & THIRD-PARTY DATA
The Application incorporates third-party data and services, including aerial imagery, parcel data, basemaps, elevation data, and flood hazard datasets provided by LightBox, Hexagon, Mapbox, the U.S. Geological Survey (USGS), and FEMA. All such data is provided "as is" without warranties of accuracy, completeness, or fitness for a particular purpose.
No data provider, including LightBox, Hexagon, Mapbox, USGS, or FEMA, endorses this Application or any outputs generated by this Application.
Data Vintage Notice: Third-party data integrated into the Application may have been collected at various times in the past and may not reflect current conditions. Parcel boundaries, flood zones, aerial imagery, zoning classifications, and other datasets may not reflect recent subdivisions, construction, boundary adjustments, annexations, remapping, or environmental changes. Some datasets may be refreshed as infrequently as once per year, depending on provider practices and geographic coverage. See the Legal Glossary for additional details. Independent verification is required before reliance.
Some data sources (USGS, FEMA, LightBox) are acknowledged in documentation and exported materials rather than persistent in-map attribution. See Terms of Use Section L for full data-use restrictions and required attributions.
Screenshots and Screen Recordings: Screenshots, screen recordings, and any other captures of Application content are considered exported materials and are subject to all attribution, disclaimer, and restriction requirements applicable to exports under the Terms of Use and EULA.
F. FIELD SAFETY
You are solely responsible for safety in the field. Be aware of surroundings, heavy machinery, uneven terrain, wildlife, weather conditions, and other hazards. Do not use the Application while operating vehicles or equipment.
G. NO PROFESSIONAL SERVICES
Nothing in this Application constitutes legal, financial, surveying, engineering, architectural, environmental, geotechnical, or regulatory advice. All outputs must be independently verified by qualified professionals before reliance.
H. COST ESTIMATES
Cost figures are generalized averages and are provided for planning purposes only. They are not bids, quotes, offers, or binding commitments. They are non-binding and may vary significantly based on site conditions, market changes, contractor pricing, material costs, labor availability, and regulatory requirements discovered during professional evaluation.
Jurisdiction Variance: Cost estimates use regional averages and do not account for jurisdiction-specific requirements, including but not limited to local permit fees, impact fees, development exactions, utility connection fees, stormwater management requirements, tree protection ordinances, historic district requirements, HOA restrictions, or building code variations. Actual costs and regulatory requirements vary significantly by jurisdiction. Users must consult local authorities, utility providers, and licensed professionals for jurisdiction-specific requirements and accurate project budgeting.
I. ASSUMPTION OF RISK & LIMITATION OF LIABILITY
THE APPLICATION AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Use of the Application and its outputs is entirely at your own risk. Total aggregate liability for all claims shall not exceed the greater of (a) the total fees paid by you to the Company in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (US $100). See the Terms of Use Section H for complete limitations of liability.

K. SEVERABILITY
If any provision of this disclaimer is found to be unlawful, void, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from this disclaimer. The remaining provisions shall remain in full force and effect.
L. ASSIGNMENT
Assignment of rights and obligations under this disclaimer is governed by the assignment provisions of the Terms of Use (Section K.6), which are incorporated herein by reference.
M. SURVIVAL
The following provisions shall survive termination or expiration of any user account and the Terms of Use: Section C (Flood, Slope, Septic & Terrain Data), Section E (Aerial, Map & Third-Party Data), Section G (No Professional Services), Section H (Cost Estimates), Section I (Assumption of Risk & Limitation of Liability), Section K (Severability), Section L (Assignment), and this Section M (Survival), as well as any other provisions that by their nature should survive.
