SiteX Legal Glossary
Definitions used throughout SiteX legal documents.
1. PURPOSE OF THIS DOCUMENT
Defines key legal terms used throughout the Terms of Use, End User License Agreement (EULA), Privacy Policy, DMCA Policy, Cookie Policy, Acceptable Use Policy, Legal Notices, and In-App Disclaimer, and catalogs all required licensing attributions for datasets integrated within SiteX. Reflects the end-user restrictions required under the Company’s agreements with its data providers, which are reproduced in the Terms of Use (Section L). This Legal Glossary is incorporated by reference into the Terms of Use, End User License Agreement (EULA), Privacy Policy, DMCA Policy, Cookie Policy, Acceptable Use Policy, Legal Notices, and In-App Disclaimer. Definitions in this Glossary are provided for reference and convenience and do not expand, limit, or modify any rights or obligations established in the governing documents. In the event of a conflict between a definition in this Glossary and the corresponding definition in any incorporating document, the definition in the governing document controls.
2. LEGAL GLOSSARY (KEY DEFINITIONS)
Company — Sitex LLC, a South Carolina limited liability company doing business as SiteX. Except where the context expressly refers to Sitex Technologies LLC’s intellectual property rights or status as licensor, references to the "Company," "we," "us," or "our" refer to Sitex LLC.
Sitex Technologies LLC — A South Carolina limited liability company that owns the SiteX patents and pending patent applications, and licenses such patents to the Company. Sitex Technologies LLC is the patent rights owner and licensor; it does not operate the Service.
Service — The SiteX mobile application, website, software, APIs, data layers, cost models, and related services provided and operated by the Company. Other than the native SiteX mobile application distributed through the Apple App Store or Google Play, the Service does not include separately downloadable desktop or on-premises software unless expressly stated in a separate written agreement. Access to Provider Data / Licensed Content is limited to the native SiteX mobile application; the website and any browser-based experience are used only for legal notices, help content, marketing, and related informational functions, and do not display, host, cache, export, or expose Provider Data / Licensed Content or Hexagon imagery except as expressly authorized in writing by the Company and, where required, the applicable provider.
User Content — Utility markers, coordinates, pads, driveway polylines, notes, or any user-entered data (non-licensed only).
Anonymized Data — Data that cannot reasonably be linked to an identified or identifiable person, retained indefinitely for system improvement; excludes any licensed or derived content (purged per licensor terms on termination).
Provider Data / Licensed Content — Datasets made available within the Service. Licensed commercial data — LightBox parcel and zoning attributes, Hexagon aerial imagery and metadata, and Mapbox basemaps — is licensed from commercial Third-Party Data Providers and is subject to their license restrictions. Government and public-domain data — USGS elevation and well data and FEMA NFHL flood layers — is not licensed commercial content and is subject to the source-specific notices in this Glossary and the Privacy Policy rather than to provider license restrictions.
Data Vintage Notice — Third-party datasets integrated into the Service may be collected, updated, or refreshed at varying intervals depending on the provider, dataset type, geographic region, and licensing terms. Some datasets may be refreshed as infrequently as once per year, or less frequently in certain jurisdictions. The Company does not control provider update schedules and does not warrant data currency. Users must independently verify all conditions, classifications, boundaries, and regulatory requirements with official sources (e.g., local authorities, FEMA, surveyors, or licensed professionals) before making any land, construction, permitting, or financial decisions.
Deterministic Workflow — Non-ML, rule-based geospatial computation performed over view-only data. The workflow produces informational outputs and does not create a reusable derivative dataset of licensed content. This approach is used by the Service for all geospatial analyses described in Terms of Use Section C.1 (Permitted Uses) and the Privacy Policy Automated Processing Disclosure.
Third-Party Data Providers — LightBox, Hexagon, Mapbox, USGS, FEMA, and others. Certain provider agreements impose separate governing law and venue obligations (e.g., Georgia for Hexagon; Delaware for LightBox).
Attribution — Mandatory legal notices acknowledging data ownership and licensing.
Prohibited Extraction — Scraping, storing, exporting, stitching, orthorectifying, or deriving datasets.
DMCA Agent — Designated contact: privacy@sitexready.com. U.S. Copyright Office Registration: DMCA-1069273.
Exports / Outputs — Any static PDF, printout, screenshot, or digital file generated by or captured from the Service that incorporates Service-generated content, licensed data, or third-party provider materials. Screenshots and screen recordings inherit all export disclaimer, attribution, and restriction requirements.
Configuration Hash — A cryptographic fingerprint (SHA-256) that uniquely identifies the combination of user inputs, system parameters, and software version used to generate an output. The hash enables tamper detection and version verification; modifications to an exported output invalidate the original hash.
Report — A structured output generated by the Service for a user-selected parcel or project that compiles estimates, modeled figures, indicators, and related planning information into a single presentation, whether viewed in the Service or produced as an Export. Reports are subject to all disclaimers, attribution requirements, and use restrictions applicable to outputs and Exports under the Terms of Use, the EULA, and the In-App Disclaimer. Reports are not surveys, engineered plans, appraisals, or regulatory submissions.
Subscription and Entitlements Definitions
Subscription — Any recurring paid SiteX plan billed through the Apple App Store or Google Play Store, including a Full Subscription or the Archive Plan, unless the context expressly states otherwise. Full Subscription: a recurring plan (currently offered as an annual plan) that provides access to the Service's paid features, parcels, outputs, and tools while active. Archive Plan: a recurring data-preservation plan that preserves eligible stored account and project data but does not provide access to the full Service, as described in Terms of Use Section D.2A.
Founding Member Plan / Founding Member Rate Lock — The limited-availability annual Full Subscription plan offered at the Service's subscription launch at US $9.99 per year to a limited number of subscribers. The base annual price of an active Founding Member Plan subscription remains locked for as long as the subscription remains continuously active; the rate lock ends and is forfeited if the subscription is cancelled, lapses, expires, or is terminated, as described in Terms of Use Sections D.2 and D.2B.
Legacy Cutoff Date — July 15, 2026, the date on which SiteX stopped offering one-time Report purchases, Report credits, one-time credits, and parcel-specific unlock purchases. Accounts that completed a qualifying purchase before this date are eligible for Grandfathered Legacy Access, as described in Terms of Use Section D.10.
Grandfathered Legacy Access — Access to the Service granted without payment of a subscription fee to accounts that completed a qualifying purchase before the Legacy Cutoff Date, including creation of Reports without per-Report purchase, credit, or quantity limit. Grandfathered Legacy Access does not expire on a fixed date but ends on refund, chargeback, or reversal of the qualifying purchase, on termination for breach or abuse, on account closure following dormancy, on discontinuation of the Service or the Report feature, or on voluntary relinquishment (account deletion or affirmative relinquishment). It does not end because a prior, lapsed, or unrelated subscription is cancelled or expires. Once ended, it is not automatically reinstated and the Company is under no obligation to re-establish it. It is per-account, non-transferable, is not a Founding Member Plan subscription, and remains subject to fair-use safeguards and third-party data availability, as described in Terms of Use Section D.10.
Free Trial — A limited free-access period (currently seven (7) days) offered to eligible users, including new users and existing account holders who have never subscribed to or trialed the Service, that automatically converts to a paid subscription unless cancelled before it ends, as described in Terms of Use Section D.3. Not available to accounts holding Grandfathered Legacy Access.
Parcel ID / parcel_id — The unique parcel identifier used by the Service to identify parcels for project association, entitlement administration, analysis, and access-control purposes.
Account Good Standing — The status of an account that remains eligible to use entitlements and the Service, and is not suspended, restricted, or terminated due to fraud, abuse, violations of the Terms, or other enforcement actions.
Fair Use Safeguards — Reasonable limitations or controls (including rate limits, verification requirements, temporary restrictions, or other enforcement actions) applied to prevent fraud, abuse, scraping, automated usage, excessive load, or misuse of the Service.
Dormant Account — An account with no login, subscription, purchase, or Service activity for a continuous period of three (3) years or more. For a dormant account, the Company may require identity verification or reactivation, suspend the account for security, and delete personal data that is no longer needed; however, the Company does not cancel or void an active paid plan merely due to dormancy, as described in Terms of Use Section D.6A. Users may avoid dormancy by logging in or otherwise using the Service.
3. DATA PROVIDER ATTRIBUTIONS (MANDATORY)
A. LIGHTBOX
Parcel and geospatial property data © LightBox. All rights reserved. Used under license. Redistribution or extraction prohibited. LightBox does not endorse this Service or any outputs generated by the Service.
B. HEXAGON
Hexagon imagery must display the attribution required under the Company's applicable Hexagon agreement and Hexagon's then-current published data-attribution guidelines. Required in-app (map footer or attribution bar) when imagery is displayed. Required in proximity to imagery in exported materials. Not for navigation, surveying, or derivative dataset creation. Users may not transfer, store, or grant access to Hexagon Content on any electronic network for use by any person without prior written permission from Hexagon. Users must comply with the Hexagon Acceptable Use Policy at https://hxgncontent.com/global/acceptable-use-policy. Hexagon does not endorse this Service or any outputs generated by the Service. Sublicense: One-tier, view-only.
C. MAPBOX
Maps and map rendering technology provided by Mapbox. © Mapbox © OpenStreetMap contributors.
D. USGS
Elevation and well log data provided by the U.S. Geological Survey (USGS). USGS data is in the public domain (see 17 U.S.C. § 105). No warranty express or implied.
E. FEMA
Flood hazard data provided by FEMA’s National Flood Hazard Layer (NFHL). Subject to change. Not an official FIRM. FEMA data is provided for general informational purposes only and is not an official flood determination, insurance determination, or compliance certification. FEMA does not endorse this Service or any outputs generated by the Service. Flood zone color coding, symbology, and legend conventions used in the Service follow standard practices derived from FEMA mapping guidelines for user familiarity; use of these conventions does not imply FEMA affiliation, endorsement, or certification. The Service does not display, reproduce, or incorporate the official FEMA seal, logo, or insignia. Unauthorized use of federal agency seals and logos is prohibited under 18 U.S.C. §§ 506, 701, and 1017. For official flood zone determinations, consult FEMA directly or obtain an official FIRM through your local floodplain administrator. See also 44 CFR Parts 59–78 for NFIP regulations. In accordance with FEMA’s NFHL metadata guidance, the Company acknowledges FEMA as the source of flood hazard data integrated into the Service.
4. PROVIDER DATA — PERMITTED USES
- In-app view-only visualization.
- Static PDFs with limited public attributes (Land Use Description, Parcel ID, Parcel Address, Lot Size, Coordinates, Use Code, and Zoning per LightBox Permitted Use; see Terms of Use Section L.3 for the complete list).
- Caching: Hexagon imagery may be cached through a Company-controlled server-side proxy (up to 14 days) and temporarily on a user’s device for personal offline use via the Mapbox SDK; LightBox Data is not cached on a user’s device beyond the current session. See Terms of Use Section L for provider-specific limits.
- Informational planning only; no professional reliance.
For avoidance of doubt, any calculations, estimates, classifications, or other informational outputs generated by the Service may incorporate user inputs, Company algorithms and cost models, public-domain data, and permitted interactions with Provider Data, and do not create, expose, or grant rights in a reusable derivative dataset of Licensed Content.
5. PROVIDER DATA — LEGAL RESTRICTIONS
- Except for the limited static outputs, permitted attribute copying, and temporary caching expressly authorized in the Terms of Use and EULA, no download, storage, stitching, derivation, resale, redistribution, or creation of extractable datasets is permitted.
- No service bureau or commercial resale.
- Comply with the end-user data restrictions reproduced in the Terms of Use, EULA, and Acceptable Use Policy, including the publicly available Hexagon Acceptable Use Policy.
6. USER DATA RETENTION & ANONYMIZATION
- User project files (pads, driveways, utility markers, notes, and other user-generated inputs) are retained while the user has a recognized active access or preservation path under the Terms of Use; after all such access and any Archive Plan end, project data is retained for the period stated in the Terms of Use and Privacy Policy, generally thirty (30) days, and then deleted unless a longer period is required by law, legal hold, or another stated retention obligation.
- Only non-licensed anonymized data retained indefinitely.
- Any licensed content cached on a user’s device is purged on termination, and the user certifies destruction where required.
- Subscription and entitlement status retained for the life of the active account, subject to account good standing and the Dormant Account policy (three (3) years of inactivity). Upon account termination, active subscription-access entitlement data may be deleted.
- Entitlement and purchase transaction history retained for four (4) years for accounting, audit, fraud prevention, legal compliance, dispute resolution, and support, and longer only where reasonably necessary for an audit, legal hold, tax matter, fraud investigation, chargeback, or unresolved dispute. This retention applies to historical transaction records and does not itself create or extend any entitlement.
7. INTELLECTUAL PROPERTY NOTICES
- SiteX™ and related marks are trademarks of Sitex LLC; SiteX patents and pending patent applications are owned by Sitex Technologies LLC and licensed to Sitex LLC.
- Licensed content owned by providers; no implied rights.
- Reproduce required attribution notices.
8. REQUIRED DISPLAY LOCATIONS
- App legal/settings screen.
- Website footer or "Data Sources" page.
