SiteX Terms of Use
Terms governing access to and use of SiteX.
Sitex LLC, a South Carolina limited liability company doing business as SiteX ("Company," "we," "us," "our"), provides the SiteX mobile application, website, software, APIs, data layers, cost models, and related services ("Service," as further defined in the Legal Glossary). Other than the native SiteX mobile application distributed through the Apple App Store or Google Play, the Service does not include separately downloadable desktop or on-premises software unless expressly stated in a separate written agreement.
Sitex LLC owns the SiteX trademarks and service marks. Sitex Technologies LLC, a South Carolina limited liability company, owns the SiteX patents and pending patent applications, and licenses such patents to the Company. Except where the context expressly refers to Sitex Technologies LLC’s intellectual property rights or status as licensor, references in these Terms to the "Company," "we," "us," or "our" refer to Sitex LLC.
These Terms of Use (“Terms”), together with the End User License Agreement (“EULA”), Privacy Policy, Legal Glossary, DMCA Policy, Acceptable Use Policy, applicable platform marketplace terms (Apple App Store / Google Play), and in-app disclaimers, form the entire agreement between you and the Company regarding your use of the Service. The Service incorporates data and imagery that the Company licenses from third-party providers, including LightBox and Hexagon (Leica Geosystems). The Company’s agreements with those providers—including the LightBox Master Services Agreement (“MSA”) and the Hexagon Derived Value Add Products Agreement (“DVAP”) and its End User Access Agreement (“EUAA”) (collectively, the “Third-Party Licensor Agreements”)—govern the relationship between the Company and those providers. You do not become a party to the Third-Party Licensor Agreements by using the Service; instead, the end-user restrictions those agreements require are reproduced directly in these Terms (see Section L), and you must also comply with the publicly available Hexagon Acceptable Use Policy (“AUP”) at https://hxgncontent.com/global/acceptable-use-policy.
By accessing or using the Service, you ("User," "you") agree to be bound by these Terms, the EULA, the Privacy Policy, the Acceptable Use Policy, and all in-app disclaimers, and you agree to the third-party data restrictions reproduced in Section L. If you do not agree, you must discontinue use of the Service.
SECTION A — ACCEPTANCE OF TERMS
These Terms govern your access to and use of the SiteX application, website, software, APIs, data layers, cost models, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms, the EULA, the Privacy Policy, the Acceptable Use Policy, and all in-app disclaimers, each of which is incorporated herein by reference, and to the third-party data restrictions reproduced in Section L.
If you do not agree with these Terms, you must discontinue use of the Service.
Acknowledgment of Data Sources and Limitations
By using the Service, you acknowledge that certain information displayed or generated by the Service is derived from publicly available datasets provided by the United States Geological Survey (USGS) and the Federal Emergency Management Agency (FEMA), as well as licensed datasets from LightBox and Hexagon.
You acknowledge that such data is provided without warranty, may be incomplete, outdated, or inaccurate, and is not intended to replace professional judgment, field verification, or official determinations.
You agree that the Company shall not be liable for decisions, actions, or outcomes based on your use of or reliance upon data originating from USGS, FEMA, LightBox, Hexagon, or other data sources integrated into the Service.
FEMA does not endorse this Service. Flood data displayed within the Service is not an official Flood Insurance Rate Map (FIRM) or official flood determination. Flood zone color coding and symbology used in the Service follow standard conventions derived from FEMA mapping practices for user familiarity; use of these conventions does not imply FEMA affiliation, endorsement, or certification. The Service does not display, reproduce, or incorporate the official FEMA seal, logo, or insignia. Unauthorized use of federal agency seals and logos is prohibited under 18 U.S.C. §§ 506, 701, and 1017.
SECTION B — USER ACCOUNTS AND ACCESS REQUIREMENTS
B.1 Account Creation
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information; maintain and promptly update your information; and keep your login credentials confidential. You may not create an account using false information or on behalf of another person without authorization. You must also comply with applicable security requirements, including keeping your login credentials confidential and not sharing them with others.
B.2 Eligibility and Age Requirements
The Service is intended for individuals 18 years of age or older who are located in the United States. By using the Service, you represent and warrant that you are at least 18 years old and are accessing the Service from within the United States. Minors are not permitted to use the Service. The Service is directed only to users in the United States; the Company does not offer or direct the Service to individuals in the European Economic Area, the United Kingdom, or other jurisdictions outside the United States, and makes no representation that the Service is appropriate or available for use in those locations.
B.3 Account Security
You are responsible for safeguarding your account credentials, restricting access to your device, and notifying us immediately of unauthorized access. The Company is not responsible for loss or damage arising from unauthorized use of your account caused by your failure to secure your credentials or device.
B.4 Account Sharing Prohibited
Each account is for individual use only unless otherwise approved in writing. You may not share your account, allow others to access your subscription, or transfer or resell your login credentials. Violations may result in suspension or termination.
B.5 Device and Platform Requirements
You may use the Service only on devices you own or control, platforms supported by the Company, and operating systems that meet minimum technical requirements. Use on rooted, jailbroken, or modified devices is strictly prohibited, including any modified device or configuration that enables unauthorized caching or extraction of licensed data.
B.6 Responsibility for All Activity
You are responsible for all activity occurring under your account, whether authorized or unauthorized.
B.7 Partner-Funded Access
If your access to the Service is purchased, invited, or funded by a business or organization (a “Partner”), the Partner is only a payer, administrator, or referral source. The Partner is not a party to these Terms, is not your licensor, and acquires no ownership, custodial, storage, redistribution, sublicensing, resale, or API rights in any Licensed Data or in any output you generate. Your use of the Service remains governed solely by these Terms and the other legal documents incorporated herein, and any business, team, or partner arrangement is governed by a separate written agreement between the Company and the Partner.
SECTION C — PERMITTED AND PROHIBITED USES
C.1 Permitted Uses
You may use the Service for:
- personal land evaluation purposes,
- internal business analysis related to site preparation or real estate,
- viewing parcels, elevation models, flood zones, imagery, and other geospatial layers,
- creating non-licensed user inputs (pads, driveways, utility markers, notes) overlaid on view-only data; no derivatives from licensed content,
- exporting your own project summaries as static PDFs (minimal permitted attributes per LightBox).
Your use must comply with all applicable laws, these Terms, the Acceptable Use Policy, and the third-party data restrictions reproduced in Section L. No public distribution, public posting, resale, standalone commercialization, or commercial sale of outputs is permitted except as expressly allowed by these Terms or approved in writing by the Company. This prohibition includes, without limitation, posting Service outputs to real estate listing platforms or services (such as Zillow, MLS, Realtor.com, Redfin, Trulia, LoopNet, or similar platforms), broker websites, social media accounts, syndication networks, or marketing collateral intended for public distribution (EUAA §7). All geospatial analyses provided by the Service use a Deterministic Workflow (as defined in the Legal Glossary). Screenshots, screen recordings, or any other captures of Service content are considered Exports and inherit all export disclaimer, attribution, and restriction requirements.
C.2 Prohibited Uses
You may NOT use the Service for any of the following:
A. Data Extraction, Scraping, or Redistribution
You may not download, export, or scrape datasets; bulk-capture imagery, parcels, elevation layers, or flood maps; create derivative datasets; use automation tools, bots, scripts, or scrapers; or mosaic/stitch/orthorectify imagery (DVAP B.2).
B. Reverse Engineering or Competitive Development
You may not reverse engineer or analyze algorithms; reproduce routing or DEM workflows; build competing products; use the Service to train AI or GIS systems for competitive purposes; or develop/distribute products/services from data (EUAA §7).
C. Unsafe or Illegal Field Use
You may not rely on approximate utility markers for digging or excavation; ignore 811 utility-locate requirements; trespass on private property; or engage in unsafe activities while using the app.
D. Professional or Regulated Uses
You may not use the Service for certified surveys, boundary determination, engineered grading plans, septic approvals, construction legal compliance, environmental approvals, any purpose requiring professional licensure or certification, or any public distribution or commercial sale of outputs without permission (none granted, EUAA §7).
E. Violations of Third-Party Provider Terms
You may not misuse LightBox parcel or geospatial data (including no bulk/raw access), Hexagon imagery, Mapbox basemaps, USGS DEM or well data, FEMA flood hazard layers, or any other licensed dataset.
F. Circumvention of Access Controls
You may not attempt to bypass subscription gates, manipulate app behavior, interfere with servers, APIs, or authentication, use modified devices or unauthorized platforms, or exceed API limits (e.g., WMTS tiles, DVAP A).
G. Account and Security Violations
You may not share accounts, credentials, passwords, or other log-in information with any third party; impersonate another user; attempt unauthorized access to other user data; probe or test system vulnerabilities; or transmit viruses. You must promptly notify the Company at legal@sitexready.com if you become aware of unauthorized access to your account, unauthorized access to Licensed Content, or suspected misuse or disclosure of Licensed Content.
H. Offline/Storage Restrictions
You may not retain, store, or extract licensed content beyond the temporary caching that the Service performs in order to function. Any offline use on your device is limited to temporary, personal caching through the Mapbox SDK and is subject to its built-in limits.
I. Machine Learning and AI Training Prohibition
Use of the Service, including any imagery, data layers, outputs, or licensed content, for the purpose of training, fine-tuning, conditioning, validating, or generating synthetic data for any machine learning system, artificial intelligence model, neural network, or large language model (LLM), whether commercial or non-commercial, is strictly prohibited.
C.3 API Access Under Separate Agreement
Notwithstanding the restrictions in Sections C.1 and C.2 and the Acceptable Use Policy, the Company may, at its sole discretion, make API access to specific Service components (such as the grading engine, rate database, or other Company-owned APIs and their outputs) available to qualified developers, businesses, or partners under a separate written API Terms of Service, Developer Agreement, or commercial license. The restrictions on public distribution, commercial exploitation, redistribution, and resale set forth in these Terms and the Acceptable Use Policy shall not apply to API access expressly authorized under such separate agreement, to the extent permitted by that agreement. Any such API access remains subject to applicable third-party licensor restrictions to the extent that licensor data flows into API outputs; APIs based solely on Company-owned intellectual property and public-domain data sources (such as USGS) are not subject to third-party licensor restrictions.
SECTION D — SUBSCRIPTIONS, BILLING, AND CANCELLATION
D.1 Subscription Access
Access to SiteX's full paid features, including full numeric cost outputs and access to all parcels and tools, requires an active paid Full Subscription. While your Full Subscription is active, you may access the paid features included in your plan, including full numeric cost outputs, the parcels and tools made available through the Service, and the creation of Reports without any per-Report purchase, credit, or quantity limit, subject to these Terms, applicable fair-use safeguards, technical availability, and third-party provider restrictions; the Service does not require, use, or sell per-parcel unlocking or per-Report credits for subscribers. Report creation is unmetered but is not exempt from the fair-use and anti-abuse safeguards described in Section D.1A. Other access paths are a free trial, Partner-funded or complimentary access, and access under a separate written agreement. SiteX does not sell one-time credits, credit bundles, or per-parcel unlocks to new users. There is no free version of the Service and no free ongoing access. When you do not have any valid access path described in this Section D.1, the Service is not available for use, and the application may display only sign-in, subscription, account-management, legal, and support screens.
D.1A Fair Use and Anti-Abuse Safeguards
The Service is intended for individual use. While we do not impose rigid usage quotas on standard accounts, we reserve the right to apply reasonable fair-use safeguards to protect the performance, security, and availability of the Service for all users. Usage that substantially exceeds typical individual use, occurs at unusually high rates within short periods, or otherwise suggests automated, non-human, scraping, or abusive behavior may trigger additional verification, temporary rate limits, restrictions on activity, or other protective measures, and may constitute a breach of these Terms and the Acceptable Use Policy. We may apply such measures before or after notifying you.
D.2 Subscription Plans and Pricing
SiteX is offered on a recurring subscription basis. As of the Effective Date, the Service is offered on a single annual plan at US $9.99 per year (the "Founding Member Plan"), exclusive of any applicable taxes. The current price is shown at the point of purchase in the Apple App Store or Google Play Store before you subscribe, and again in your platform receipt; if the price shown at checkout differs, the price shown at checkout controls. The Founding Member Plan is a limited-availability launch offer available only to a limited number of subscribers, as determined by the Company in its sole discretion. Once that limit is reached, or the Company otherwise closes the offer to new subscribers, the Company may offer different plans and pricing to new subscribers, as described in Section D.2B. An optional Archive Plan for data preservation is also offered, at the current price shown at the point of purchase in the applicable app store, as described in Section D.2A. Subscriptions are billed in advance through the applicable app store for the period you select.
D.2A Archive Plan (Optional Data Preservation)
The Archive Plan is an optional, separate subscription that preserves your stored account and project data (such as projects, waypoints, and plans) on our servers after your Full Subscription ends, so it is available again if you later reactivate a Full Subscription. The current price of the Archive Plan, exclusive of any applicable taxes, is shown at the point of purchase in the Apple App Store or Google Play Store; if the price shown at checkout differs from any price stated elsewhere, the price shown at checkout controls. The Archive Plan is billed in advance through the applicable app store and automatically renews each month until you cancel, on the automatic-renewal and cancellation terms in Sections D.4 and D.5. The Archive Plan preserves your data but does not provide access to it: while you are on the Archive Plan and not on an active Full Subscription, your parcels, numeric outputs, tools, and stored project data are not accessible, and access is restored only when you reactivate a Full Subscription. If you cancel the Archive Plan, preservation stops and your stored data is handled as described in Section D.11. The Archive Plan and a Full Subscription are intended as alternative plan states rather than concurrent plans; any plan change, proration, credit, billing date, and effective date is controlled by the applicable app-store checkout and subscription-management flow.
D.2B Founding Member Pricing and Rate Lock
If you subscribe to the Founding Member Plan, the base annual price of your Founding Member subscription will not increase for as long as that subscription remains continuously active (the "Founding Member Rate Lock"). The Founding Member Rate Lock applies to the base subscription price only; it does not include applicable taxes or app-store fees, and it does not apply to the Archive Plan or to any other plan, add-on, or offering. If your Founding Member subscription is cancelled, lapses, expires, is not renewed, is refunded, charged back, or reversed, or is terminated for breach, the Founding Member Rate Lock ends and is forfeited, and any subsequent subscription will be at the plans and pricing available at that time, which may differ. The Company may close the Founding Member Plan to new subscribers, introduce additional plans, or change pricing for new subscribers at any time; such changes do not affect the locked base price of an active Founding Member subscription. The Founding Member Rate Lock is a pricing commitment only and does not guarantee the continued availability of any particular feature, dataset, tool, or third-party content.
D.3 Free Trial
We offer a seven (7)-day free trial to eligible users, including both new users and existing account holders who have never subscribed to or trialed the Service. The automatic-renewal terms, including the price that will be charged when the trial ends, are disclosed to you at sign-up. Unless you cancel before the deadline shown by your app store, your free trial will automatically convert into a paid subscription at the price disclosed at sign-up, and the payment method on file with your app store will be charged. Where required by applicable law, we or the app store will provide a reminder before your trial converts to a paid subscription. Free trials are limited to one per user and are not available to users who have previously subscribed to or trialed the Service, or to accounts holding Grandfathered Legacy Access under Section D.10. Trial availability, length, and eligibility may be determined by the app store and/or the Service and may vary by user or promotion. Because there is no free version of the Service, if you cancel during the free trial, your access to the Service ends at cancellation or at the end of the trial period (depending on the applicable app store’s handling), and you will have no further access to the Service unless you purchase a subscription.
D.4 Automatic Renewal
YOUR SUBSCRIPTION AUTOMATICALLY RENEWS. Before you begin a free trial or purchase a subscription, the applicable automatic-renewal terms, including the price, billing frequency, any trial-conversion terms, and how to cancel, are displayed clearly and conspicuously in proximity to the purchase or subscription control in the Apple App Store or Google Play Store, and you must affirmatively consent before the transaction is completed. At the end of each subscription period (monthly or annual, as applicable), your subscription automatically renews for an additional period of the same length at the then-current price, and the payment method on file with your app store is charged, unless you cancel before the renewal date. You authorize the app store to store your payment method and to charge it on each renewal until you cancel. The Company or the applicable app store may retain records reasonably necessary to verify your consent. These automatic-renewal terms apply to each paid plan you purchase, including the annual plan (including the Founding Member Plan), the Archive Plan, and any other plan the Company may offer.
D.5 Cancellation
You may cancel your subscription at any time through your Apple App Store or Google Play Store subscription settings (on iOS, Settings > your name > Subscriptions; on Android, the Google Play Store > Subscriptions). Subscriptions are billed and managed by the app stores, so you generally cancel through the same platform you used to subscribe. The Company does not control your Apple or Google account and does not guarantee that it can complete a cancellation on your behalf; you remain responsible for confirming cancellation through the applicable platform. Cancellation takes effect at the end of the then-current billing period; if you cancel a Full Subscription, you retain access to paid features until that period ends, and you will not be charged for the following period. To prevent a free trial from converting to a paid subscription, cancel by the deadline shown by the applicable app store before the trial ends; platform-specific processing deadlines may apply. Because there is no free version of the Service, once your paid or trial access ends following cancellation or non-renewal, you will have no further access to the Service unless you subscribe again; the optional Archive Plan preserves eligible stored data but does not provide access, as described in Section D.2A.
D.6 Refunds, Chargebacks, and Revocation
All sales are final to the extent permitted by law. Subscriptions are billed through the Apple App Store or Google Play Store, and refunds are handled by those platforms under their policies and applicable law; the Company does not separately process refunds for app-store purchases. Where platform terms or mandatory platform policies grant you a right (such as a refund) that conflicts with these Terms, the platform terms control to the extent of the conflict, and nothing in these Terms waives any right you have that cannot be waived under applicable law. If a charge is refunded, charged back, reversed, or determined to be fraudulent or abusive, we may suspend or terminate access and revoke associated entitlements (including any access obtained through that charge) pending investigation.
D.6A Dormant Account
To help prevent fraud, reduce stale-account risk, and maintain accurate records, we may treat an account as dormant after three (3) years of no activity (no login, subscription, purchase, or Service activity). For a dormant account, we may require identity verification or reactivation before further use, suspend the account for security reasons, and delete personal data that is no longer needed, in each case to the extent permitted by law. We will not, however, cancel or void an active paid plan merely because an account is dormant; it remains subject to applicable app-store policies. We will attempt to provide notice using the contact information on file before taking dormancy-related action, and you may avoid dormancy by logging in or otherwise using the Service. For clarity, this does not affect the retention of transaction records for accounting, audit, fraud prevention, legal compliance, dispute resolution, and support purposes as described in the Privacy Policy.
D.7 Price and Plan Changes; Notice
We may change subscription prices, plans, or available offers. For existing subscribers, a price change applies to your next renewal, except that an active Founding Member Plan subscription retains its locked base price as described in Section D.2B for as long as it remains continuously active. We will provide advance notice of any price increase or other material change to your subscription as required by applicable law and applicable app-store rules, together with information about how to cancel. If you do not cancel before the change takes effect, the new price or terms apply to your next renewal.
D.8 Renewal Reminders
Where required by applicable law, the Company or the applicable app store will provide the notices required for your plan, which may include a reminder before renewal of an annual plan, a reminder before a qualifying free trial or promotional period converts to a paid subscription, and notice of a material price or subscription change. Each such notice will identify the subscription, the amount and frequency of the charge, and how to cancel, and will be provided through the app store and/or the contact or notification method associated with your account.
D.9 Taxes
Displayed prices may not include applicable taxes; taxes (if any) are determined by the app store and your location. The app-store checkout and receipt govern the final amounts charged.
D.10 Legacy Purchases
SiteX stopped offering one-time Report purchases, Report credits, one-time credits, and parcel-specific unlock purchases on July 15, 2026 (the "Legacy Cutoff Date"), and the legacy "Pro" and "Max" tiers are closed. Reports remain a feature of the Service and are available to subscribers without per-Report purchase, credit, or quantity limit, as described in Section D.1.
Grandfathered Legacy Access. If, before the Legacy Cutoff Date, your account completed a purchase through the Service (including any Report purchase, Report credit, one-time credit, or parcel-specific unlock), your account is eligible for Grandfathered Legacy Access. Grandfathered Legacy Access provides the same paid features that are made available to an account with an active Full Subscription under Section D.1, including full numeric cost outputs, the parcels and tools made available through the Service, and the creation of Reports without any per-Report purchase, credit, or quantity limit, in each case without payment of a subscription fee and without expiring on a fixed date. If the paid features included in a Full Subscription change, Grandfathered Legacy Access reflects those features as then made available to subscribers, subject to the limitations in this Section D.10. Eligibility does not depend on whether you created a project or used any particular feature; a completed purchase is sufficient. Where the Company’s records show a qualifying purchase, Grandfathered Legacy Access is applied to the account automatically; if you believe your account qualifies and it has not been applied, contact support, and the Company will apply it upon reasonable verification of the purchase.
Grandfathered Legacy Access is granted per account, is non-transferable, has no cash or refund value, and may not be resold, shared, or sublicensed. It is not a Founding Member Plan subscription and does not include the Founding Member Rate Lock. It is subject to these Terms, the EULA, and the Acceptable Use Policy in the same manner as a paid subscription, including the fair-use and anti-abuse safeguards in Section D.1A; "without any per-Report purchase, credit, or quantity limit" means that Reports are not metered or separately charged, and does not waive those safeguards or authorize automated, bulk, scraping, or abusive use.
Grandfathered Legacy Access continues until it ends under this paragraph. It ends if: (a) the qualifying purchase is refunded, charged back, reversed, or determined to be fraudulent or abusive, as described in Section D.6; (b) the account is suspended or terminated for breach, fraud, abuse, or unlawful activity, as described in Section D.13; (c) the account becomes dormant and is closed as described in Section D.6A; or (d) the Company discontinues the Service, or the Report feature, in whole or in part, as described in Section J; or (e) you voluntarily end it by deleting or closing your account, or by affirmatively declining or relinquishing the access. For the avoidance of doubt, Grandfathered Legacy Access is not delivered as a paid or auto-renewing subscription, and it does not end because a prior, lapsed, or unrelated subscription of yours is cancelled, expires, or is not renewed; only the events listed in this paragraph end it. If the Company later delivers Grandfathered Legacy Access through a subscription, entitlement, or store-level product, cancelling or disabling that product ends the access. Grandfathered Legacy Access is a commitment not to charge a subscription fee for the access described above; it is not a guarantee of the continued availability of the Service, of any particular feature, dataset, tool, output format, or third-party content, and it remains subject to the continued availability of third-party licensed data under the Third-Party Licensor Agreements and to the restrictions in Section L. The Company may modify or replace the Report feature, and may make changes to the Service, in the ordinary course. Grandfathered Legacy Access is not automatically reinstated. Once it ends under this Section D.10, the Company is under no obligation to reinstate it, a prior qualifying purchase does not entitle you to have it re-established, and any further access to the Service requires a paid subscription at the plans and pricing then available, which will not be the Founding Member Plan unless that plan is then open to new subscribers. The Company may reinstate Grandfathered Legacy Access in its sole discretion, including to correct an administrative error, and any such reinstatement is not a waiver of this Section.
Accounts that exist but have not completed a qualifying purchase before the Legacy Cutoff Date are not eligible for Grandfathered Legacy Access and may access the Service through the free trial and subscription described in this Section D. If you hold a legacy recurring subscription that is still billing as of the Legacy Cutoff Date, contact support; the Company will transition the account to a current plan or to Grandfathered Legacy Access, as applicable, without duplicate charges.
D.11 Effect of Cancellation or Expiration on Access
When your Full Subscription ends by cancellation, non-renewal, or expiration, your access to paid features, parcels, and full numeric outputs stops. This Section D.11 does not apply to an account holding Grandfathered Legacy Access, which continues to have access as described in Section D.10 until that access ends under that Section. To preserve your other stored account and project data (such as projects, waypoints, and plans) for later use, you may subscribe to the optional Archive Plan described in Section D.2A; while you are on the Archive Plan, that data is retained but is not accessible until you reactivate a Full Subscription. The thirty (30)-day period begins when you no longer have any active Full Subscription, free trial, Partner-funded access, complimentary access, Grandfathered Legacy Access under Section D.10, separate-agreement access, Archive Plan, or platform-recognized grace or account-hold entitlement; at that point your stored account and project data is retained for thirty (30) days and then deleted, except where longer retention is required by law or by the Privacy Policy. Canceling the Archive Plan stops preservation and begins the thirty (30)-day deletion period.
D.12 Restore Purchases
Your subscription status and any eligible non-consumable purchases may be synchronized using your app store's restore-purchase function (for example, after reinstalling the app or switching devices). If your subscription does not appear after a restore, contact support.
D.13 Termination and Forfeiture for Breach
If your account is suspended or terminated for breach of these Terms, fraud, abuse, or unlawful activity, you may lose access to the Service, and we may revoke or forfeit remaining entitlements, to the extent permitted by law.
SECTION E — INTELLECTUAL PROPERTY RIGHTS
Sitex LLC owns the intellectual property rights in the Service software, algorithms, and non-licensed content. Sitex LLC also owns the SiteX trademarks and service marks. Sitex Technologies LLC owns the SiteX patents and pending patent applications, which are licensed to Sitex LLC. Licensed Content (e.g., Hexagon imagery, LightBox parcels) is owned exclusively by the respective licensors and is licensed, not sold (EUAA §4; LightBox MSA).
You may not challenge licensor ownership or use licensor trademarks without prior written consent (DVAP 5.1, 5.3). You must protect licensed content from unauthorized use (DVAP 5.1). The Company may create only those overlays, resized displays, and other derivative products that are expressly authorized under its agreements with its data providers; you receive no independent right to modify Licensed Content. See Section L for attribution requirements.
DMCA Compliance. For copyright infringement claims, including claims related to third-party licensor intellectual property, please see our DMCA Policy or contact privacy@sitexready.com (our designated DMCA agent of record with the U.S. Copyright Office). U.S. Copyright Office Registration: DMCA-1069273.
SECTION F — CONFIDENTIALITY
Hexagon Content, nonpublic provider materials, access credentials and methods, and other information that is designated as confidential or that a reasonable person would understand to be confidential are Confidential Information. This obligation does not restrict your authorized viewing of Licensed Content, your copying of the limited LightBox attributes expressly permitted by Section L.3, your retention of authorized outputs, or your use of public-domain government data. You agree to:
- maintain it in strict confidence,
- not disclose or use except as expressly permitted herein,
- use reasonable care to protect it (at least industry standard),
- limit access to authorized personnel,
- notify the Company immediately upon discovering any current or threatened unauthorized disclosure, use, access, or breach involving Licensed Content; the Company may notify the applicable provider as required,
- upon termination, return or destroy all copies and certify in writing.
Exceptions apply to information that is publicly known (without breach), independently developed, or required by law (with prior notice). You must cause your personnel to comply (EUAA §7).
SECTION G — USER CONTENT
You retain ownership of non-licensed inputs you provide (e.g., project notes, custom markers). By submitting, you grant us a worldwide, royalty-free license to use, host, store, and display such content solely as necessary to provide, maintain, secure, improve, and operate the Service and to comply with applicable laws. You represent that your content does not infringe third-party rights and contains no licensed data. We may remove user content that violates these Terms.
SECTION H — DISCLAIMERS AND LIMITATIONS OF LIABILITY
THE SERVICE, INCLUDING ALL OUTPUTS, LAYERS, AND ANALYSES, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT (DVAP 7.4; EUAA §11). WE DISCLAIM ALL LIABILITY FOR ACCURACY, COMPLETENESS, OR TIMELINESS OF DATA. OUTPUTS ARE INFORMATIONAL ONLY AND NOT PROFESSIONAL ADVICE; DO NOT RELY ON THEM FOR DECISIONS.
IN NO EVENT SHALL WE OR LICENSORS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS. OUR AND LICENSORS’ TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) FEES PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Exceptions to Limitations of Liability. The disclaimers and limitations of liability set forth in this Section H shall NOT apply to, and shall not in any way limit, the following: (a) Your indemnification obligations to the Company, Sitex Technologies LLC, and other indemnitees under Section I; (b) liability arising from a party’s gross negligence, willful misconduct, or fraud; (c) Your infringement of the Company’s, Sitex Technologies LLC’s, or any licensor’s intellectual property rights, including unauthorized use, copying, redistribution, or derivative use of Licensed Content; (d) Your breach of confidentiality obligations under Section F; (e) Your violation of any third-party data restriction set forth in these Terms (including Section L) or of the Hexagon Acceptable Use Policy; (f) amounts owed by You to the Company for fees, taxes, chargebacks, or refund obligations; or (g) any liability that cannot be excluded or limited under applicable law (including, in certain jurisdictions, liability for death or personal injury caused by negligence).
SECTION I — INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Sitex LLC, Sitex Technologies LLC, and their respective officers, directors, employees, agents, successors, and assigns, as well as all licensors and data providers (including Hexagon and LightBox), from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising from your breach of these Terms, the EULA, the third-party data restrictions in Section L, or the Hexagon Acceptable Use Policy; your misuse of the Service, including any use beyond the scope of the license granted herein; any unauthorized extraction, copying, redistribution, or derivative use of licensed content; your violation of any applicable law, regulation, or third-party right; or any claim that your use of the Service caused harm, damage, or loss to any third party.
SECTION J — TERMINATION
J.1 By Company
We may terminate or suspend your access for convenience with 30 days' notice, immediately for breach (including non-compliance with the restrictions in Section L or the Hexagon AUP), if required by law, government authority, or court order, or if the Company discontinues part or all of the Service.
Failure to comply with the Hexagon AUP constitutes a material breach and may result in immediate suspension or termination. Hexagon may update the AUP; continued use after updates constitutes acceptance.
J.2 Effect of Termination
Upon termination: your right to use the Service stops immediately, account access may be disabled, project files and personal content may be deleted. You must cease all use, delete licensed views/caches, destroy all copies of Confidential Info, and certify in writing (EUAA §13). Except where required by applicable law or platform marketplace rules (such as Apple App Store or Google Play Store refund policies), no refunds will be issued.
Notwithstanding the foregoing, a User may retain static PDF exports generated through the Service prior to termination for a period not to exceed seven (7) years, solely for purposes of legal compliance, professional record-keeping, insurance, regulatory requirements, or defense of claims, and not for any active commercial project, redevelopment, resale, redistribution, or new site evaluation. This retention permission does not authorize the retention of any Licensed Content that must be deleted or destroyed under Section L or under an applicable data-provider requirement; to the extent an export contains such Licensed Content, that deletion or destruction requirement controls. Any required attribution and use restrictions continue to apply to retained exports.
J.3 Survival of Terms
The following sections survive termination: Section C.2 (Prohibited Uses; see also EULA Section F.3, which survives all of EULA Section C including attribution requirements), Section D.6 (Refunds, Chargebacks, and Revocation), Section D.13 (Termination and Forfeiture for Breach), Section E (Intellectual Property Rights), Section F (Confidentiality), Section G (User Content, to the extent necessary for the Company to retain permitted data), Section H (Disclaimers and Limitations of Liability), Section I (Indemnification), Section J.2 (Effect of Termination), this Section J.3 (Survival of Terms), Section K (General Provisions), Section L (Third-Party Licensor Data Restrictions) and the publicly applicable Hexagon Acceptable Use Policy, and any other rights or obligations that by their nature should survive. The survival provisions of these Terms and the EULA are cumulative and each independently enforceable.
SECTION K — GENERAL PROVISIONS
K.1 Governing Law
Except where third-party data provider agreements expressly require otherwise, these Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles. For clarity, the Company’s agreements with its data providers are governed by their own controlling law, including Georgia law for Hexagon (Leica Geosystems) and Delaware law for LightBox; those agreements govern the relationship between the Company and each provider, and nothing in these Terms alters or overrides those requirements.
K.2 Venue and Jurisdiction
Any dispute arising out of or relating to the Service or these Terms shall be brought exclusively in the state or federal courts located in South Carolina, subject to the arbitration provisions in Section K.9. You consent to the personal jurisdiction of such courts.
K.3 Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, power outages, telecommunications failures, data provider interruptions, government actions, war or civil unrest, or other force majeure events. Force majeure does not excuse payment obligations.
K.4 Entire Agreement
These Terms, together with the EULA, Privacy Policy, Legal Glossary, DMCA Policy, Acceptable Use Policy, in-app disclaimers, and any other legal notices provided by the Company, constitute the entire agreement between you and the Company. The third-party data restrictions required by the Company’s providers are reproduced in Section L; the Third-Party Licensor Agreements are not part of this agreement with you and do not confer rights on you. These Terms and the user-facing documents incorporated into them supersede all prior agreements between you and the Company regarding the Service. In the event of a conflict between these Terms and the EULA, these Terms shall govern unless the EULA expressly provides otherwise with respect to software licensing matters. In the event of a conflict between these Terms and the Privacy Policy, the Privacy Policy shall govern with respect to the collection, use, and disclosure of personal information, and these Terms (including Section L) shall govern with respect to third-party data licensing restrictions, intellectual property obligations, and attribution requirements, even where those topics overlap with data practices.
K.5 Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be modified or severed to the minimum extent necessary. The remaining provisions shall remain in full force and effect.
K.6 Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent. The Company may assign its rights or obligations to affiliates, successors, or acquiring entities without notice or consent, provided that the assignee agrees to be bound by these Terms with respect to all user-facing obligations, including liability limitations, dispute resolution, and data-licensing restrictions. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and permitted assigns.
K.7 Export Compliance
You agree to comply with all applicable United States, Canadian, European Union, and Swiss export control laws and sanctions regulations. You may not export, re-export, transfer, or release any data from the Service to any U.S., EU, Swiss, or Canadian embargoed country, any person on the U.S. Treasury Department’s Specially Designated Nationals list, the U.S. Commerce Department’s Table of Denial Orders, or any EU, Swiss, or U.S. Denied Parties Lists.
K.8 Relationship of the Parties
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and the Company. You are an independent user of the Service.
Your use of the Service does not create a partnership, joint venture, agency, employment, or direct contractual relationship between you and Hexagon, LightBox, or any other licensor, except for the limited third-party-beneficiary enforcement rights expressly provided in these Terms or applicable marketplace terms.
K.9 Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Disputes") will be resolved exclusively through binding individual arbitration, rather than in court, except that you or the Company may assert claims in small claims court if the claims qualify. For arbitration involving intellectual property, software licensing, data licensing, or SaaS-related disputes, the parties shall request that the AAA appoint arbitrators with substantial experience in software, technology licensing, or software-as-a-service platforms. The unavailability of an arbitrator with such experience shall not invalidate or delay the arbitration.
CLASS ACTION WAIVER: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE COMPANY EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.
Equitable Relief for Intellectual Property and Data Misuse. Notwithstanding the agreement to arbitrate, the Company may seek temporary, preliminary, or permanent injunctive relief, specific performance, or other equitable remedies in any court of competent jurisdiction (including the state and federal courts located in South Carolina) without first proceeding to arbitration, in connection with: (a) any actual or threatened infringement, misappropriation, or unauthorized use of the Company’s or any licensor’s intellectual property rights; (b) any unauthorized extraction, scraping, copying, redistribution, or derivative use of Licensed Content (including LightBox parcel data, Hexagon imagery, or Mapbox tiles); (c) any breach or threatened breach of confidentiality obligations under Section F; or (d) any violation of the Acceptable Use Policy that, if not promptly enjoined, would cause irreparable harm. The parties agree that monetary damages alone would be inadequate to remedy such breaches and that the Company is entitled to seek equitable relief without the necessity of proving actual damages or posting bond. Pursuit of equitable relief in court under this paragraph shall not be deemed a waiver of the right to arbitrate any other claim.
Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at https://www.adr.org/Rules. The arbitration shall be seated in South Carolina; in-person hearings may be conducted in the county of your residence at your election. You may opt out of this arbitration provision by sending written notice to legal@sitexready.com with subject line "ARBITRATION OPT-OUT" within thirty (30) days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.
Mass Arbitration and Bellwether Procedure.
If twenty-five (25) or more similar arbitration demands are filed against the Company by the same, substantially similar, or coordinated counsel, or based on the same or substantially similar legal theories ("Mass Arbitration"), the AAA Mass Arbitration Supplementary Rules then in effect shall apply to the administration of those demands and shall control over any inconsistent provision of this Section K.9. The parties acknowledge that under those rules a Process Arbitrator may be appointed to resolve administrative or procedural disputes (including challenges to filing compliance, conditions precedent, and fee allocation), and the parties agree to abide by Process Arbitrator rulings as provided in the AAA rules. The parties will participate in any global mediation required under the then-current AAA Mass Arbitration Supplementary Rules, subject to any right to opt out of or other procedure provided by those rules, with such mediation administered concurrently with the arbitrations as provided therein.
To the extent the AAA Mass Arbitration Supplementary Rules do not otherwise specify a procedure for bellwether case selection, the parties request that the AAA randomly select ten (10) demands (the "Bellwether Cases") to proceed first to merits arbitration, with the remaining demands held in abeyance pending resolution of the Bellwether Cases, subject to the AAA’s administration of the Mass Arbitration. Following the resolution of the Bellwether Cases, the parties shall engage in good-faith discussions, including any further mediation as the AAA may direct, to resolve the remaining demands. Any applicable statute of limitations for demands held in abeyance under this provision shall be tolled during the pendency of the Bellwether Cases and any related mediation.
K.10 Audit Rights
You agree to use the Service in compliance with these Terms and the third-party data restrictions in Section L. The financial and compliance audit procedures contained in the Company’s agreements with its data providers run between the Company and those providers and are not applied to individual users; nothing in these Terms subjects you to a provider audit or to any obligation to reimburse provider audit costs.
K.11 Flow-Down Requirements
These Terms reproduce the end-user restrictions that the Company is required to pass through under the Third-Party Licensor Agreements; by using the Service, you agree to those restrictions as set forth in these Terms (including Section L) and to the publicly available Hexagon Acceptable Use Policy. You do not become a party to the Third-Party Licensor Agreements, which continue to govern the relationship between the Company and its providers. The Company remains responsible to its providers for its own compliance, and you are responsible for your compliance with these Terms.
K.12 Optional Educational Resources
The Company may, at its discretion, offer optional educational resources, tutorials, or training materials related to use of the Service. Any such materials are informational only and do not modify the limitations, disclaimers, or allocation of responsibility set forth in these Terms.
K.13 No Waiver
The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Company.
K.14 Modifications to Terms
The Company may update or modify these Terms at any time. When we make material changes, we will update the effective date at the top of these Terms and provide notice by one or more of the following: posting a notice within the Service or on our website at https://sitexready.com/legal, sending an email or in-app notification, or other reasonable means. Non-material changes (such as clarifications or formatting adjustments) may be made without separate notice. Where changes to end-user restrictions are required by the Company’s data providers (for example, updates to the Hexagon Acceptable Use Policy), they may take effect immediately, with notice provided as practicable. Material changes affecting fees, recurring billing, dispute resolution, user rights, data practices, or access will be communicated through reasonable notice and, where required by law or designated by the Company, may require renewed affirmative acceptance. Non-material changes may become effective upon posting. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms only where renewed affirmative acceptance is not required. If you do not agree with any changes, you must stop using the Service. Changes shall not broaden user rights beyond licensor terms.
K.15 Notices
Any notice required or permitted under these Terms may be provided by the Company via email to the address associated with your account, in-app notification, or posting on the Company’s website at https://sitexready.com/legal. Notice is deemed received upon sending (for email or in-app notification) or upon posting (for website notices). You are responsible for keeping your contact information current. Notices from you to the Company must be sent to legal@sitexready.com.
K.16 Limitations Period
For users or claims governed by South Carolina law, nothing in these Terms shortens any otherwise applicable statute of limitations for any claim arising out of or relating to these Terms, the Service, or any contract between you and the Company.
For claims not governed by South Carolina law, any claim must be filed within one (1) year after it accrues only to the extent a shorter contractual limitations period is permitted by the governing law and only for claims for which the governing law allows such shortening by agreement. This Section does not apply where applicable law prohibits a shortened limitations period or provides a non-waivable limitations period.
Any applicable limitations period will be tolled during any mandatory pre-suit notice, informal dispute-resolution process, mediation, or administrator review required by these Terms.
If any portion of this Section is unenforceable, the otherwise applicable statute of limitations will govern, and the remainder of these Terms, including any arbitration provision, will remain in effect to the fullest extent permitted by law.
K.17 Limited Third-Party Beneficiaries
These Terms are solely for the benefit of the parties hereto and their permitted successors and assigns. No third party shall have any rights or remedies under or by reason of these Terms, except that (a) the licensors identified in Section L (including Hexagon and LightBox) and (b) the indemnitees identified in Section I are intended third-party beneficiaries with the right to enforce the provisions specifically applicable to them.
K.18 Headings
Section, subsection, and paragraph headings used in these Terms are for convenience and reference only and shall not affect the interpretation, construction, or meaning of any provision.
K.19 Master Priority and Conflict Resolution
In the event of a conflict between or among the documents governing your use of the Service, the following order of precedence shall apply (highest to lowest): (a) the third-party data restrictions reproduced in these Terms (including Section L) and any publicly applicable provider terms (such as the Hexagon Acceptable Use Policy and the Mapbox Terms of Service) shall control with respect to the licensed third-party data to which they apply, and where a provider requirement is more restrictive than another provision of these Terms, the more restrictive provider requirement controls as to that data; (b) these Terms of Use, including Section L (Third-Party Licensor Data Restrictions), shall control with respect to general Service use, intellectual property, liability, indemnification, and dispute resolution; (c) the End User License Agreement (EULA) shall control with respect to software licensing matters not addressed in these Terms; (d) the Privacy Policy shall control with respect to the collection, use, disclosure, and storage of personal information; (e) the Acceptable Use Policy, DMCA Policy, and Cookie Policy shall control with respect to their respective subject matter (user conduct, copyright enforcement procedures, and cookies/tracking); (f) the In-App Disclaimer shall control with respect to risk acknowledgments and limitations on professional reliance for in-app outputs; and (g) the Legal Glossary and Legal Notices are reference documents and shall not override any operative provision in the documents above. Where a single subject matter is addressed in multiple documents, the more specific provision controls over the more general. Section-specific conflict-resolution clauses elsewhere in these or any incorporating document shall be interpreted consistently with this Section K.19.
K.20 Acceptance and Record Retention
By creating an account, accessing, or using the Service, you manifest assent to these Terms and all incorporated documents through an affirmative action (such as tapping or clicking an "I Agree" button or equivalent control). The Company may maintain electronic records reasonably designed to document contract formation and assent, including the applicable document version, date and time of acceptance, associated account, and acceptance event. The Company will retain these records for the duration of the user’s account plus any applicable statute-of-limitations period or other retention period required by applicable law. Such records may be used as evidence of notice and assent in any dispute. When the Company materially modifies these Terms, the Company will notify users and, where required by law or designated by the Company, may require renewed acceptance through a similar affirmative action; continued use of the Service after the effective date constitutes assent to the updated Terms except where renewed affirmative acceptance is required.
SECTION L — THIRD-PARTY LICENSOR DATA RESTRICTIONS
This Section supplements and governs all requirements relating to licensed mapping, imagery, and geospatial datasets displayed within the Service. These restrictions are required under the licensing terms of Mapbox, OpenStreetMap contributors, Hexagon, and LightBox. Where any conflict exists between this Section L and any other portion of these Terms, this Section L controls. Access grants no broader rights than expressly stated (DVAP 2.3). Data provided through the Service may be outdated or incomplete and, in some cases, may be refreshed as infrequently as once per year. See the Legal Glossary for additional information regarding data vintage and verification requirements. Mapbox services used within the Service, including any maps or static images appearing in exported materials, are accessed and rendered under the Company's licensed Mapbox account. Users receive no independent rights to Mapbox services or data beyond view-only access as presented through the Service, subject to all attribution and use restrictions.
Native-Application-Only Access to Licensed Data. Access to Hexagon Content and any other Licensed Data subject to third-party streaming restrictions is limited to the native SiteX mobile application. The Company’s website and any browser-based experience are used only for legal notices, help content, marketing, and related informational functions, and may not display, host, cache, export, or expose Licensed Data or Hexagon imagery except as expressly authorized in a written agreement signed by the Company and, where required, the applicable data provider. Nothing in this Section L limits Section C.3, which governs Company-owned API access under a separate written agreement and preserves all applicable third-party licensor restrictions on any licensor data flowing into API outputs.
L.1 Mandatory Attribution Requirements
The Service relies on multiple third-party providers across various zoom levels and visualization layers. Attribution requirements differ based on context of display (live in-app UI vs. exported materials):
"© Mapbox" — Required for all Mapbox satellite, aerial, and tile-serving infrastructure used in the Service. This attribution is the minimum requirement; any additional attribution required by Mapbox for the selected style, tileset, or data suppliers (as specified in Mapbox documentation or TileJSON) must also be included.
"© OpenStreetMap contributors" — Required when using Mapbox Streets or any Mapbox vector layers incorporating OpenStreetMap data.
Hexagon attribution as required under the Company's applicable Hexagon agreement and Hexagon's then-current published data-attribution guidelines — Required in-app (map footer or attribution bar) when Hexagon aerial imagery is displayed. Also required in exported materials containing Hexagon imagery.
"© LightBox" — Required in exported materials (PDFs, exports) containing LightBox parcel data. No persistent in-app attribution required.
L.2 In-App Attribution Exclusions and Export Obligations
The following data sources do not require persistent in-app attribution: USGS elevation data (public domain), FEMA flood hazard data (provided it is presented as informational and non-authoritative), and LightBox parcel data. These sources are acknowledged in documentation and exported materials rather than persistent in-map UI.
Any PDFs, exports, screenshots, maps, or other exported content that contain or depict licensed or government data must include the applicable attribution lines on the same page as the imagery or data. Users may not obscure, remove, alter, or reposition attribution in any manner that diminishes visibility or accuracy. No watermarking is required. Exported maps containing Mapbox content will include Mapbox attribution in accordance with Mapbox's static and print attribution guidance, including the Mapbox logo where required by Mapbox documentation.
L.3 LightBox Data Restrictions
Parcel, zoning, and assessor attribute data is provided by LightBox. Data © LightBox. Use of LightBox Data is licensed solely for in-app view-only display and integration into the Service per MSA.
- Except for the limited LightBox attributes that the Service is expressly permitted to include in static PDF outputs (as set out in this Section), End Users may not download, export, scrape, bulk-access, extract, or reuse LightBox Data.
- Only minimal permitted subsets (Land Use Description, Parcel ID, Parcel Address, Lot Size, Coordinates, Use Code, Zoning) may appear in static PDF exports; primary purpose must be Service content, not LightBox Data alone.
- Permitted copying: Parcel ID, Parcel Address, Coordinates, Tax Address only.
- End Users may not cache or retain LightBox Data on their devices beyond the current session. This restriction does not limit the Company's storage and use of LightBox Data under its enterprise license. No derivative datasets, databases, or extractable data products may be created from LightBox Data.
All intellectual property rights remain exclusively with LightBox. No implied license is granted. LightBox does not endorse this Service or any outputs generated by the Service.
Zoning Verification Required. Zoning classifications displayed within the Service are derived from third-party data sources and are provided for informational reference only. Such classifications may not reflect current zoning designations, pending amendments, overlay districts, conditional use permits, variances, planned unit developments, special exceptions, or other land use restrictions, entitlements, or encumbrances. Users must verify all zoning matters directly with the applicable local planning, zoning, or permitting authority before any land use, purchase, or development decisions.
L.4 Hexagon Imagery Restrictions
Aerial imagery, orthophotography, and map tiles (collectively, “Hexagon Content” or “Hexagon imagery”) are provided by Hexagon under the Derived Value Add Products Agreement. Hexagon imagery must display the attribution required under the Company's applicable Hexagon agreement and Hexagon's then-current published data-attribution guidelines. End User access to Hexagon imagery is granted as a limited, non-exclusive, non-transferable sublicense for personal or internal business use only, not for resale, and is limited to a term of one (1) year, subject to automatic renewal contingent upon the Company’s continued licensing from Hexagon. The Service may generate on-screen visualizations and limited, low-resolution map thumbnails within project outputs that incorporate Hexagon imagery for documentation purposes only. Use of Hexagon imagery is subject to the following:
- Hexagon imagery is provided as a view-only streaming basemap within the native application. As currently implemented, the Service displays Mapbox basemaps at lower zoom levels and streams Hexagon ortho imagery at zoom levels 19–20, within the range licensed by Hexagon (zoom 18–20).
- Except for the limited, low-resolution imagery thumbnails that the Service is expressly permitted to include in static PDF outputs (as set out in this Section), users may not download, copy, export, scrape, redistribute, mosaic, stitch, orthorectify, or create derivative datasets, databases, or extractable data products from Hexagon imagery outside the application environment.
- The Company may cache Hexagon imagery through a Company-controlled server-side proxy with a time-to-live of up to fourteen (14) days. On an end-user device, imagery may be cached only temporarily, for personal offline use, through the Mapbox SDK and subject to its built-in limits.
- Any permitted exports must include Hexagon attribution as required under the Company's applicable Hexagon agreement and Hexagon's then-current published data-attribution guidelines in proximity to the imagery. See EULA Section C.4 for complete attribution requirements.
- Users may not alter, obscure, or remove any Hexagon copyright notices.
- Users may not transfer, store, or grant access to Hexagon Content on any electronic network without prior written permission from Hexagon (none granted via Service).
- Users must comply with the Hexagon Acceptable Use Policy at https://hxgncontent.com/global/acceptable-use-policy, as updated from time to time.
All intellectual property rights remain exclusively with Hexagon. No implied license is granted. Hexagon does not endorse this Service or any outputs generated by the Service. Sublicense: One-tier, view-only.
L.5 Mapbox, USGS, and FEMA
Map tiles, geocoding, and base layers are provided by Mapbox. Use subject to Mapbox Terms of Service. Required Attribution: © Mapbox © OpenStreetMap contributors.
Elevation, 3DEP, terrain, and well data is provided by USGS (public domain per 17 U.S.C. § 105; no warranty).
Flood zone data is provided by FEMA NFHL (informational only; not official FIRM; consult FEMA for determinations; see 44 CFR Parts 59–78 for NFIP regulations). Flood zone color coding, symbology, and legend conventions used in the Service follow standard practices derived from FEMA mapping guidelines for user familiarity. Use of these conventions does not imply FEMA affiliation, endorsement, or certification. The Service does not display, reproduce, or incorporate the official FEMA seal, logo, or insignia. Unauthorized use of federal agency seals and logos is prohibited under 18 U.S.C. §§ 506, 701, and 1017. In accordance with FEMA’s NFHL metadata guidance, the Company acknowledges FEMA as the source of flood hazard data integrated into the Service.
L.6 No Implied License to Third-Party Data
Except for the limited, view-only access and sublicense expressly granted in this Section L, access to the Service grants users no rights, title, or license in any content owned or controlled by Mapbox, OpenStreetMap contributors, Hexagon, or LightBox. All rights not expressly granted are reserved by the respective providers. No redistribution, resale, or service bureau/time-sharing (EUAA §7).
L.7 Survival
This Section L shall survive termination of these Terms and any user account to the maximum extent permitted by law.
L.8 Data Vintage Acknowledgment
Third-party data integrated into the Service may have been collected at various times in the past and may not reflect current conditions. Parcel boundaries, flood zones, aerial imagery, zoning classifications, and other datasets may not reflect recent subdivisions, construction, boundary adjustments, annexations, remapping, environmental changes, or other modifications occurring after the original data collection date. Data refresh cycles vary by provider and geographic area. Users must verify that all information reflects current conditions before reliance.
